Warranty terms for new construction in Spain
Depending on the type of damage, the term is determined. All those involved (developer, contractor, architect and technical architect) are considered jointly responsible.
New construction - acceptance - liability
By the construction law (LOE - Ley de Ordenación de la Edificación) some warranty periods are granted.
Depending on the type of damage, the term is determined.
All those involved (developer, contractor, architect and technical architect) are considered jointly responsible.
These periods are as follows:
- 10 years for structural defects (beams, columns, floors, foundations, retaining walls, etc.).
- 3 years for defects in elements or features that affect the habitability of the building.
- 1 year for defects in workmanship.
These terms start from the completion of the work by the builder (notarized deed - completion) and not from the purchase of the property.
